Maltivas ("we," "our," or "the Platform"), operated by Maltivas Corp, respects the intellectual property rights of creators and complies with the Digital Millennium Copyright Act ("DMCA"). We expect all creators and users who upload or publish content to Maltivas to respect the intellectual property rights of others.

This policy explains how copyright owners can report alleged infringement and how users may respond if their content has been removed in error.

If you believe your copyrighted work has been copied, uploaded, streamed, or made available on Maltivas without your authorization, you may submit a DMCA Takedown Notice as described below.

How to Submit a DMCA Takedown Notice

To submit a valid DMCA notice, your written request must include:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material that is claimed to be infringing, including URLs or direct links.
  • A statement that you have a good-faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information provided in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  • Your full name, address, email, and phone number.
  • Your physical or electronic signature.

Upon receiving a valid notice, Maltivas Corp will remove or disable access to the reported material and notify the user who posted it.

Counter-Notification Procedure

If your content was removed due to a DMCA Takedown Notice and you believe it was a mistake or that you have the legal right to use the material, you may submit a DMCA Counter-Notification.

Your counter-notice must include:

  • Your name, address, phone number, and email address.
  • Identification of the material that was removed and its previous location (URL).
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed due to mistake or misidentification.
  • A statement that you consent to the jurisdiction of the Federal District Court for your address and that you will accept service of process from the person who filed the original DMCA notice.
  • Your physical or electronic signature.

Once received, Maltivas Corp will forward your counter-notice to the original complainant. Unless the complainant files a legal action within 10–14 business days, the removed material may be restored.

Repeat-Infringer Policy

Maltivas Corp enforces a strict repeat-infringer policy in accordance with the DMCA.

A user may be classified as a repeat infringer if they receive:

  • Three (3) valid DMCA notices within a 12-month period, or
  • Demonstrate a pattern of infringing behavior.

Consequences may include:

  • Removal of content
  • Temporary suspension
  • Permanent account termination

Note: Maltivas Corp reserves the right to immediately terminate accounts in severe or obvious infringement cases.
